Terms of Service

1. Acceptance of terms

By creating an account or using Burgndy.ai, you agree to these terms. If you don’t agree, don’t use the service.

2. What Burgndy.ai is

Burgndy.ai is an AI-assisted app builder: you describe an app, our system generates real source code, compiles it into a real running app or web service, and — depending on the plan and platform — lets you test it on a real emulator/simulator and deploy it to a real URL or your own domain.

3. Your account

You’re responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate information when signing up.

4. Your content and generated apps

• You own the apps you generate, subject to these terms and to any third-party rights in content you provided (e.g. images or reference designs you upload).
• You’re responsible for ensuring your prompts and any resulting app comply with applicable law and don’t infringe anyone else’s rights.
• We may remove content or suspend accounts that violate these terms or the acceptable-use rules below.

5. AI-generated output

Generated code is produced by AI models (Anthropic Claude and/or Google Gemini) and is provided “as is.” We run real automated tests as part of generation, but AI-written code can still contain bugs or security issues — review it yourself, especially before relying on it for anything handling real user data, payments, or other production-critical use.

6. Payments, credits, and billing

• Paid plans and credit top-ups are billed through Razorpay, our payment processor.
• Current plans, credit pools, and per-action costs are shown on your real Billing page — that page, not this document, is the source of truth for current pricing.
• Subscriptions renew automatically until cancelled; you can cancel anytime from Billing.
• Refunds are handled case-by-case — contact advaita@burgndy.ai rather than assuming a specific policy, since we don’t have a fixed automatic-refund rule published yet.

7. Acceptable use

You agree not to:

• Use the service to generate or distribute illegal content, malware, or content that infringes others’ rights.
• Attempt to bypass usage quotas, credit limits, or the sandboxed execution environment’s isolation.
• Use generated compute/AI capacity for purposes unrelated to building your own app (e.g. reselling raw API access).
• Attack, probe, or disrupt Burgndy.ai’s infrastructure or other users’ apps/data.

8. Third-party services you connect

If you connect your own Razorpay merchant account, GitHub account, or services like Twilio/ SendGrid/Slack, you’re responsible for complying with those providers’ own terms. Burgndy.ai stores those credentials encrypted and uses them only to act on your behalf as you’ve configured.

9. Termination

You can stop using Burgndy.ai and delete your account at any time. We may suspend or terminate accounts that violate these terms, with notice where practical.

10. Disclaimer and limitation of liability

The service is provided “as is” without warranties of any kind. To the extent permitted by law, Burgndy.ai isn’t liable for indirect, incidental, or consequential damages arising from your use of the service or of any app you generate with it.

11. Governing law

These terms are governed by the laws of India, without regard to conflict-of-law principles. (Flagged above — confirm this matches your actual business registration before treating it as final.)

12. Changes to these terms

If these terms change materially, we’ll update the date at the top of this page.
